What is wrongful dismissal?

Wrongful dismissal occurs when a term of the contract of employment has been breached, as distinct from a contravention of a statutory right, such as protection against unfair dismissal.

An example of a wrongful dismissal would be if your employer, having terminated your employment, had failed to pay you for the full period of your statutory notice entitlement. Employment tribunals have jurisdiction on wrongful dismissal as well as unfair dismissal claims.

It is worth noting that, for wrongful dismissal, there is no service qualification period for making a claim.
