What is the timetable for information and consultation negotiations?

Where a valid request for information and consultation rights has been made an employer must:

  • Enter into negotiations within a month
  • Make arrangements for the employees to elect or appoint negotiating representatives. Where trade unions are recognised within an undertaking, the Department of Trade and Industry's guidance recognises that union representatives 'are likely to be well placed' to act as negotiating representatives, but the Regulations do not require this
  • Conclude negotiations within six months, unless both sides agree to an extension
