Where a valid request for information and consultation rights has been made an employer must:
- Enter into negotiations within a month
- Make arrangements for the employees to elect or appoint negotiating representatives. Where trade unions are recognised within an undertaking, guidance produced by the DTI (now Department for Business, Innovation and Skills) recognises that union representatives 'are likely to be well placed' to act as negotiating representatives, but the Regulations do not require this
- Conclude negotiations within 6 months, unless both sides agree to an extension.
