What are my rights, on transfer of my employer's business, if I do not want to work for the new owner?

There is no obligation to transfer over, but if you refuse to transfer, your contract of employment will come to an end and you will be treated as having effectively resigned. There is no dismissal in law, so you normally cannot claim unfair dismissal nor a redundancy payment. However, you may be able to, where the transfer has been seriously flawed, or you have been offered inferior terms and conditions by the new employer.
