I have seen a list of actions that might be regarded as 'gross misconduct' in the disciplinary rules. Will these automatically result in dismissal?

The ACAS Code of Practice on Discipline and Grievance emphasises that disciplinary procedures should give a clear indication of the type of conduct which will be regarded as gross misconduct and which may warrant summary dismissal. It would not be possible for employers to include a complete list of matters which could lead to summary dismissal, so it is usual to mention some of the more obvious examples, such as, theft, fraud, fighting and deliberate damage to property.

Allegations of gross misconduct should be fully investigated and employers decide, in the light of all the circumstances, after a disciplinary hearing, whether dismissal on the grounds of gross misconduct is appropriate.
