Can my employer vary my contract of employment to include a restrictive covenant?

A restrictive covenant is an express term in the contract which seeks to prevent the employee from carrying out a particular activity, usually in competition with the employer.

As such any attempt to add such a term without agreement would be an opposed unilateral variation and a breach of contract. The employer could not, therefore, lawfully vary your contract in this way without your agreement.
