What are my rights if I resign?
If you quit work to get away from intolerable working conditions, you have the right under the Employment Rights Act 1996 to claim 'unfair constructive dismissal'. Your claim must be submitted to an Employment Tribunal within 3 months of the day you last worked.
-
Your claim is based on your individual employment rights under employment legislation and also the common law.
-
Think twice before walking out. Bringing a claim of constructive dismissal in the tribunal is a very difficult process, so it is always best to get advice first.
