No. In an Employment Tribunal (ET) case, the tribunal will need to consider evidence to decide whether you are disabled or not for the purposes of the Act.
In many ET cases, the employer's first line of defence is to deny that you, the claimant, are 'disabled' under the terms of the legislation. So proper legal and medical advice is essential unless disability is not contested. The ET will treat each case on its own merits.
